Settlement Reached in Police Brutality Charge, City Still Must Release Incriminating Files

DENVER -- City attorneys have reached a settlement with Jason Graber who accused officer Shawn Miller of police brutality earlier this year.

Last week U.S. District Judge John Kane ordered the city to produce eight years of police excessive-force complaints, documents the city's attorney was reluctant to turn over. Those involved in the case believe the city agreed to the settlement with Graber to avoid handing over the incriminating documents. "This is not a private personnel matter; this is a public trust matter," said David Lane, Graber's attorney.

It is unlikely that the city's settlement with Graber will absolve them from the requirement of making the records public.

Monday Kane ordered the city to release the same documents in another police brutality charge against Miller by James Moore who also claims he was beat by the Denver officer.
